A Chapter 7 petition for bankruptcy results in a discharge or release from all debts that you may have. A Chapter 13 petition for bankruptcy has a goal of getting approval for a repayment plan for existing debts and/or creditors. The repayment plan is designed to allow you to make payments over a span of three to five years to your creditors at a rate that you can afford. The goal in a Chapter 7 bankruptcy is to wipe out all of your debts, but in the process this can require you to give up certain property. A Chapter 13 plan may be more appropriate when you do not want to give up certain property such a home in which you have substantial equity which creditors might otherwise be able to attach.
